Did You Know?

  • The Corps of Engineers requires a property owner to delineate federal wetlands.
  • The EPA has lowered the threshold of permitting for soil disturbance caused by construction activity from 5 acres to 1 acre.
  • In many cases the permitting of soil disturbance caused by construction activities is regulated by individual states. These states will establish their own regulations for meeting the federal requirements.
  • In many states, wetland disturbances, as well as delineations, are regulated by the state agencies and federal agencies differently. To complicate matters further, many local counties and municipalities also regulate wetland disturbances through zoning and buffer requirements.
